Terms and Conditions:

1. Scope of Work:

  • JCM Paving & Building agrees to provide landscaping and patio services as agreed-upon
     

2. Payment Terms:

  • Full payment for services rendered is due upon completion of the project, unless otherwise specified in writing.

  • A deposit may be required before commencement of work, with the remaining balance payable upon project completion.

  • Ownership of Materials: All materials provided by JCM Paving & Building shall remain the property of JCM until full payment for the services rendered is received.

  • Payment Schedule: Full payment for services rendered is required at the end of each project, as outlined in the contract.

  • Non-Payment Consequences: Failure to settle outstanding balances for labor costs may result in legal action. JCM reserves the right to file a claim in the small claims court to recover unpaid fees.

  • Credit Rating Impact: In the event of non-payment, a claim to the small claims court may adversely affect your credit rating until the matter is resolved.

  • Resolution Process: Clients are encouraged to promptly address any payment discrepancies to avoid legal actions and credit rating repercussions.

  • By engaging with JCM Paving & Building, you agree to adhere to these ownership and payment terms.
     

3. Project Changes:

  • Any changes to the scope of work must be agreed upon in writing by both parties.

  • Additional costs resulting from changes to the original scope of work will be discussed and approved by the client before implementation.
     

4. Warranty:

  • JCM Paving & Building provides a warranty on all workmanship and materials used in the project for a period of [insert duration] from the date of completion.

  • This warranty covers defects in workmanship and materials under normal use and maintenance.
     

5. Client Responsibilities:

  • The client agrees to provide clear access to the project site and any necessary utilities required for the completion of the work.

  • Any landscaping plans, permits, or approvals required by local authorities are the responsibility of the client.
     

6. Completion Timeframe:

  • JCM Paving & Building will make reasonable efforts to complete the project within the agreed-upon timeframe.

  • Delays due to factors beyond our control, such as inclement weather or unforeseen circumstances, may impact the project timeline.


7. Termination of Agreement:

  • Either party may terminate the agreement in writing if the other party breaches any material term of the contract.

  • Upon termination, the client shall pay for all work completed up to the termination date, as well as any additional costs incurred by JCM Paving & Building.


8. Dispute Resolution:

  • In the event of a dispute arising from this agreement, both parties agree to first attempt to resolve the matter through negotiation and mediation.

  • If mediation is unsuccessful, either party may pursue legal action in accordance with the laws of [insert jurisdiction].


9. Governing Law:

  • This agreement shall be governed by and construed in accordance Irish Consumer Protection
     

10. Entire Agreement:

  • This agreement constitutes the entire understanding between JCM Paving & Building and the client, 
     

By engaging with JCM Paving & Building, the client acknowledges and agrees to abide by these terms and conditions.
